These GTC apply to contracts with both consumers and business entities. Mandatory statutory consumer protection provisions remain applicable to consumers.
2. Products and Conclusion of Contract
The online shop offers basketball shoes, sportswear, basketballs, fan merchandise, and sports accessories from various brands.
The presentation of products does not constitute a legally binding offer, but rather an invitation to place an order.
By completing the ordering process, the customer submits a binding offer to purchase. The automated order confirmation acknowledges receipt of the order. A sales contract is only concluded upon express acceptance or the dispatch of the goods. Before finalizing the order, the customer may review and correct their information.
3. Prices and Shipping Costs
All stated final prices include theapplicable statutory value-added tax (VAT), unless explicitly indicated otherwise.
Additional shipping costs are displayed prior to the completion of the order.
For deliveries outside the European Union, import duties, customs charges, or other fees may apply. To the extent permitted by law, these shall be borne by the recipient.
4. Payment Methods
The payment methods available in the online shop are displayed during the ordering process.
These may include, in particular:
- PayPal
- Visa and Mastercard
- Bank transfer (if offered)
- Other payment methods displayed at checkout
Payment is processed in accordance with the terms of the selected payment method.
5. Delivery and Shipping
Delivery is available to the countries listed during the ordering process.
The estimated delivery time is indicated for each product or during the ordering process.
Unless a different delivery period has been agreed upon, delivery shall generally take place no later than 30 days after the conclusion of the contract.
Should an ordered item be unavailable, the customer will be informed immediately. In the event of non-delivery, any payments already made will be refunded in accordance with statutory provisions. For consumers, the risk of accidental loss or damage generally only passes to the customer (or an authorized recipient) upon physical handover of the goods.
6. Statutory Right of Withdrawal
In the case of distance contracts, consumers generally have the right to withdraw from the contract within 14 days without providing any reason.
The withdrawal period generally begins on the day the consumer—or a third party designated by the consumer (other than the carrier)—receives the goods. For partial deliveries, the relevant statutory rules regarding the start of the withdrawal period shall apply. To exercise the right of withdrawal, a clear statement sent via email or letter to the following address is sufficient:
Sport & Shoe Trading Ges.m.b.H.
St. Peter Straße 5
9020 Klagenfurt am Wörthersee
Austria
E-mail: office@basketball-point.com
To meet the withdrawal deadline, it is sufficient for you to send your notice of withdrawal before the withdrawal period has expired
7. Consequences of Withdrawal
In the event of a valid withdrawal, we shall refund all payments received from the consumer, including the costs of the most affordable standard delivery option offered.
The refund will be issued without undue delay and no later than 14 days from the date on which we receive the notice of withdrawal.
We may withhold the refund until we have received the goods back or the consumer has provided proof that they have sent the goods back, whichever occurs first.
The refund will generally be made using the same payment method as the original transaction, unless otherwise expressly agreed.
The consumer must return or hand over the goods no later than 14 days after submitting the notice of withdrawal.
The consumer shall bear the direct costs of returning the goods, provided that they were duly informed of this prior to the conclusion of the contract and no other agreement has been made. The consumer is only liable for any diminished value of the goods if such loss in value is due to handling the goods in a way that was not necessary for checking their nature, characteristics, and functioning. Statutory exceptions to the right of withdrawal—for example, in the case of certain custom-made or personalized products—remain unaffected.
8. Statutory Warranty
The statutory warranty provisions apply.
For consumer purchases, the statutory warranty period for new goods is generally two years from the date of delivery.
In the event of defective products, consumers are entitled to statutory rights—such as repair, replacement, price reduction, or rescission of the contract—subject to the applicable legal requirements. Any additional manufacturer’s warranty does not limit these statutory warranty rights.
9. Retention of Title
The delivered goods remain the property of Sport & Shoe Trading Ges.m.b.H. until the full purchase price has been paid.
10. Liability
Liability is governed by statutory provisions.
Mandatory legal claims—particularly those concerning personal injury, intent, gross negligence, or liability under product liability law—remain unaffected.
11. Data Protection
Personal data is processed in accordance with applicable data protection regulations, in particular the General Data Protection Regulation (GDPR).
Further information regarding the processing of personal data, the service providers used, and the rights of data subjects can be found in the online shop’s separate privacy policy.
12. Complaints and Dispute Resolution
Customers may direct complaints and inquiries to the following email address:
office@basketball-point.com
Information regarding mandatory or voluntary participation in alternative dispute resolution procedures will be provided separately.
13. Applicable Law
Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers, mandatory protective provisions of the country in which they have their habitual residence remain unaffected, provided these are applicable under the relevant legal regulations. For business entities (entrepreneurs), Klagenfurt am Wörthersee is agreed upon as the place of jurisdiction, to the extent permitted by law. For consumers, the statutory provisions regarding legal jurisdiction apply.
14. Final Provisions
Should individual provisions of these General Terms and Conditions be invalid, the remaining provisions shall remain in effect, to the extent permitted by law.
The General Terms and Conditions in effect at the time the contract is concluded shall apply.
